1. Introduction

Welcome to Ricardo’s Painting & Construction. These Terms & Conditions (“Terms”) govern your use of our website and our provision of painting, construction, carpentry, gutter-cleaning, roofing and related home‐repair services (“Services”). By accessing our website or engaging us for Services, you accept and agree to these Terms.

 

2. Scope of Services

We provide residential and commercial painting, carpentry, cabinet refinishing, gutter cleaning, roofing installation & repair, and other home‐repair services in the Charlotte/Matthews area (and surrounding locations) as described on our website. We will supply a detailed estimate outlining scope, price, schedule and any specific materials required. Any additional work outside the estimate must be agreed in writing or via change order.

 

3. Estimates, Quotes & Work Authorization

3.1. We provide free estimates; acceptance of an estimate constitutes authorization for us to proceed under the terms of this agreement.
3.2. The scope of work may change due to unforeseen conditions (for example hidden damage, substrate issues, weather, building code requirements). We will notify you of changes and provide a revised cost or schedule for your approval.
3.3. Cancellation by the client after work has commenced may incur costs for materials ordered or work already done.

 

4. Payment Terms

4.1. Unless otherwise agreed in writing, payment is due as outlined in the estimate (for example deposit, progress payment(s), final payment) prior to or upon completion of Services.
4.2. We accept cash, card and checks (as indicated on our website).
4.3. If payment is not received when due, we reserve the right to suspend work, withhold deliverables or charge interest/late fees as allowed by law.
4.4. Final payment constitutes your acknowledgement that work has been completed to your satisfaction, unless you have submitted written notice of deficiency within a reasonable period.

 

5. Changes & Additional Work

Any changes to the scope of work must be set out in writing (via change order) and signed by both parties before additional work is commenced. Additional costs or delays caused by client‐requested changes or unforeseen conditions shall be added to the original estimate.

 

6. Site Access, Safety & Responsibility

6.1. You shall provide appropriate site access, utilities (water, electricity) and a safe working environment free of hazards.
6.2. We will exercise standard safety precautions, but you remain responsible for removing or securing items of personal property, pets, valuables and maintaining proper insurance.
6.3. We are not responsible for pre‐existing damage, hidden defects, or loss/damage to items not properly protected unless due to our negligent acts.

 

7. Materials, Warranties & Defects

7.1. We will use materials of good quality (unless you specify otherwise) and workmanship in line with industry standards.
7.2. Any manufacturer warranties for products used will be passed on to you if possible.
7.3. You must notify us in writing of any defects or issues within [insert period, e.g., 30 days] after completion. We will, at our discretion, repair or correct defects caused by our workmanship. This warranty does not cover natural wear & tear, damage from misuse, or client‐altered work.

 

8. Limitation of Liability

8.1. To the fullest extent permitted by law, our liability for any claim arising out of or related to the Services shall be limited to the amount paid by you for the affected Services.
8.2. We will not be liable for any indirect, consequential, special or punitive damages, including lost profits, loss of use, or business interruption, even if advised of the possibility of such damages.

 

9. Indemnity

You agree to indemnify and hold harmless Ricardo’s Painting & Construction, its officers, employees, contractors and agents from any claims, damages, losses or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your negligence or misuse of the site or Services.

 

10. Termination & Cancellation

10.1. We may terminate or suspend work if you fail to meet payment obligations, provide access or otherwise breach these Terms, upon written notice.
10.2. You may cancel or terminate an estimate or service engagement before work begins. After work commences, cancellation may incur charges for labour, materials and commitments already made.
10.3. On termination, you shall pay for work completed to date and be responsible for any materials committed.

 

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed under the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Services shall first be attempted to be resolved through informal discussion. If not resolved, the dispute may be submitted to mediation or binding arbitration in [insert county, e.g., Mecklenburg County], North Carolina, or otherwise pursued in a court of competent jurisdiction in that state.

 

12. Intellectual Property & Website Use

12.1. All content on the website (text, images, graphics, logos) is owned or licensed by Ricardo’s Painting & Construction and is protected by copyright.
12.2. You may not modify, reproduce, distribute or use website content without our written permission.
12.3. We may revise the website and these Terms at any time; your continued use of the website or engagement of our Services after changes means you accept the new Terms.

 

13. Privacy

Your use of our website and provision of personal information is governed by our Privacy Policy [link to your Privacy Policy]. By accepting these Terms, you also accept the terms of the Privacy Policy.

 

14. SMS/Text Messages

 

14.1 SMS Program Description

Our SMS program provides text messages for appointment reminders, events, receipts, customer service, and occasionally promotional messages when you opt in. Message frequency varies depending on your interaction with our services.

14.2 Opting Out

You can cancel the SMS service at any time. Simply text “STOP” to the shortcode (number provided). Upon sending “STOP”, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, or text “START” to resume receiving messages.

14.3 Help & Support

If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance or email admin@risingphoenixpartners.com.

14.4 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

14.5 Message and Data Rates

Message and data rates may apply for messages sent to you from us and from you to us. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

14.6 Recurring Messages Disclosure

By opting into our SMS program, you authorize us to send recurring text messages to the mobile phone number you provide. Depending on your service selection, you may receive regular recurring messages. You are not required to agree to receive recurring messages as a condition of purchasing any goods or services.

14.7 Prohibited Content

Our SMS messages will never contain:

  • Phishing attempts, smishing, or social engineering to manipulate you into sharing private information
  • Illegal content (all content complies with federal and state laws)
  • SHAFT content (sex, hate, alcohol, firearms, and tobacco) that does not follow federal and state law and regulations

14.8 SMS Opt-In Data Protection

All text messaging originator opt-in data and consent information will not be shared with any third parties, excluding aggregators and providers of the Text Message services necessary to deliver the SMS service. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

14.9 Privacy for SMS Services

15. Force Majeure

Neither party shall be liable for delays or failure in performance caused by events beyond its reasonable control, including acts of God, fire, flood, storms, acts of war or terrorism, strikes, pandemics, governmental orders or other unforeseeable events.

 

16. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce a right under these Terms does not constitute a waiver of that right.

 

17. Entire Agreement

These Terms (and any estimate, change-order form and accepted proposal) constitute the entire agreement between you and Ricardo’s Painting & Construction regarding the Services and supersede all prior discussions, agreements or representations.
